Terms of Use

Last updated: October 21, 2026 — Version 1.4

1. Purpose and acceptance

These Terms and Conditions ("Terms") govern access to and use of the Pania CM mobile application ("the App", "the Service") published by NG & Auto Cameroun SARL, a company incorporated under the laws of Cameroon ("Pania", "we", "us"). By creating an account or using the App, you ("User", "you") agree, without reservation, to these Terms and to the data and cookie collection notice below. If you do not agree, you must not use the App.

2. Description of the service

Pania CM lets users compare product prices across Cameroonian markets, browse recipes, manage a budget, receive price alerts, contribute prices, and rate the accuracy of prices reported by other users. Some features are only available to authenticated accounts.

3. Eligibility and account creation

Use of the App is strictly prohibited for anyone under 16 years of age: by creating an account or using the App you confirm that you are at least 16. If we find that an account belongs to someone under 16, we may suspend or delete it, and the associated data, without notice. Creating an account requires accurate information (phone number or email address, display name, favorite market). You are responsible for keeping your credentials confidential and for all activity under your account. You must read and expressly accept these Terms before you can sign up: acceptance is given by ticking the checkbox on the sign-up screen, and without it no account can be created.

Accounts. Every account has the same access to the App's features, including contributing and rating prices. Administration of the App is carried out only by Pania's team, from its web admin dashboard; no administrative role can be obtained from within the App. Pania may suspend or withdraw an account if these Terms are breached.

4. User-submitted content

Prices, photos, reviews, and other content you submit ("User Content") must be accurate and submitted in good faith. You grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that User Content as part of the Service. You remain solely responsible for the User Content you submit.

Pania has zero tolerance for abusive, hateful, discriminatory, sexual, violent or misleading content and for abusive users. You can report content from Profile → "Report a problem" or at support@nextgenafrika.com: reported content is reviewed and removed, and the accounts concerned suspended, within 24 hours.

5. Collection and processing of personal data

5.1 Data we collect
Depending on how you use the App, we collect: (a) identification and contact data (display name, phone number, email address); (b) declared location data (favorite market, city); (c) usage data (products viewed, prices submitted, favorites, in-app browsing history); (d) technical and device data (device identifier, device type, operating system, IP address, error logs); and (e), where applicable, a profile photo.

5.2 Purposes of processing
This data is processed to: provide and personalize the Service (showing prices for your favorite market, alerts); secure accounts and prevent fraud; provide technical support; produce anonymized usage statistics; and, where you consent, display advertising.

5.3 Legal basis and compliance
This processing is carried out in accordance with Law N° 2010/012 of 21 December 2010 on Cybersecurity and Cybercriminality in Cameroon, Law N° 2010/013 of 21 December 2010 governing Electronic Communications in Cameroon, and the applicable Cameroonian legal framework on the protection of personal data. Depending on the case, processing relies on your consent (obtained at sign-up and for optional features), on the performance of the contract formed by these Terms, or on our legitimate interest in securing and improving the Service.

5.4 Data sharing
Your data may be shared with: our technical hosting and infrastructure providers (acting as processors, under our instructions); mobile money payment operators (MTN Mobile Money, Orange Money) solely for processing a payment you initiate; competent Cameroonian administrative or judicial authorities, upon lawful request and under the conditions set by Law N° 2010/012. We do not sell your personal data to third parties.

5.5 Data retention
Your data is kept for as long as your account exists, then archived or deleted within a reasonable period after deletion, subject to any retention periods required under applicable Cameroonian law (including anti-cybercrime legislation).

5.6 Your rights
Subject to the applicable Cameroonian legal framework, you have a right to access, rectify, delete, and object to the processing of your personal data. You may exercise these rights, or delete your account, from the App's Profile page or by contacting us (see section 14).

5.7 Security
We implement reasonable technical and organizational measures (encrypted communications, access controls) to protect your data against unauthorized access, loss, or alteration, in line with the requirements of Law N° 2010/012.

6. Cookies and similar technologies

The App does not use browser "cookies" in the strict sense, but uses equivalent mobile technologies: local storage on your device (preferences, session, cache) and advertising identifiers/tracking technologies used by our advertising partners (including Google AdMob) for audience measurement and ad display. These identifiers can be reset or disabled from your device's privacy settings.

7. Payments

The App is free. It is funded by advertising, by partners and sponsors clearly identified as such, and by delivery fees. Delivery services are physical services provided by partner providers; their prices and payment terms are shown before you place any order. Mobile money transactions are processed under each operator's own terms and security; Pania never has access to your mobile money credentials. Any payment made outside the channels indicated by Pania is at your own risk (see section 10.3).

Cancellation and refunds: you can cancel a delivery order free of charge until the rider has picked it up, by contacting the rider or support@nextgenafrika.com. Groceries are paid to the rider on receipt. If a delivery fee paid by Mobile Money is for a delivery that did not take place, it is refunded to the same Mobile Money account within 14 days of your request.

8. Acceptable use

You may not use the App to: fraudulently access or alter a computer system or data (within the meaning of Law N° 2010/012); knowingly submit inaccurate prices or information; commit or attempt any scam, swindle, or other fraud, or mislead, deceive, or take advantage of other people (for example by posing as a seller, a collector, or a Pania representative, or by posting fake offers, fake prices, or fake reviews); impersonate another person; harass other users; or compromise the security, availability, or integrity of the Service. Any breach may result in suspension or deletion of your account, without prejudice to criminal proceedings under Cameroonian law.

9. Intellectual property

The App, its brand, design, and editorial content are the property of Pania or its licensors and are protected under Cameroonian intellectual property law. Nothing in these Terms grants you any right over these elements, other than a personal, non-exclusive right to use the App.

10. Limitation of liability

10.1 Prices and content
Displayed prices partly come from user contributions and are provided for indicative purposes only; Pania does not guarantee their real-time accuracy. To the extent permitted by Cameroonian law, Pania shall not be liable for indirect damages arising from use of the App.

10.2 Conduct of users and third parties
Pania is not a party to any exchange, agreement, or transaction between users, or between a user and a third party (seller, trader, collector, or anyone else). Pania is not responsible for the actions of users or third parties and, to the extent permitted by Cameroonian law, accepts no liability for any harm (loss of money, theft, scams, fraud, misleading information, identity theft) resulting from use of the App to scam or mislead other people. A user who commits such acts is solely responsible, both civilly and criminally, and agrees to indemnify Pania against any third-party claim arising from them.

10.3 Transactions outside the App
We recommend that you do not blindly trust offers, contacts, or information received through the App, that you verify the identity of the other party and the goods yourself before any purchase, and that you never pay or transfer money (Mobile Money, bank transfer, cash, or otherwise) outside the App to anyone you do not know or cannot verify. Pania never asks for your PIN, password, or a payment by private message. Pania is not responsible for payments or transactions made outside the App and cannot guarantee, cancel, or refund them.

11. Suspension and termination

We may suspend or delete an account in case of breach of these Terms, in particular the conduct described in section 8. You may delete your account at any time from the Profile page.

12. Changes to these Terms

We may amend these Terms to reflect changes to the Service or to applicable regulation. Material changes will be notified within the App and may require renewed acceptance before you can continue using the Service.

13. Governing law and jurisdiction

These Terms are governed by the law of the Republic of Cameroon. Any dispute concerning their interpretation or performance falls under the exclusive jurisdiction of the competent Cameroonian courts.

14. Contact
